So last week we received an email from the BBC threatening court action against us for using the name TopGear Karting and also images and the wording of ‘The Stig’… it looks like they’ve hit an all-time low, fitting as the series finale also ended on one.
Now, we’ve been trading under the name TopGear Karting since 1999 and might we add Top Gear, which has been trademarked by the BBC has an evident space in-between Top and Gear, that’s issue number one sorted.
After speaking to the previous owners of the track we can now reveal that TopGear Karting has been trading under this name since 1993, even longer than we first anticipated.
Next they moved onto ‘The Stig’ so were not allowed to have a guy dressed as ‘The Stig’ named ‘The Stig’… ok so now he’s our Tamed Racing Driver but shhhh it’s really ‘The Stig’. Most companies would see this as a plus, were promoting their program to our customers, you know potential viewers, and god knows they need them (this weekend the antique roadshow received more views). Instead the BBC see’s the use of the Stig as detrimental, the mind boggles. So if we can’t use the Stig for birthday parties, we guess Disney will be throwing around court action for people dressing up as Elsa and Anna for parties then? We think not.
They then claim its infringement as we are using similar aspects to Top Gear the show and that it is likely to confuse customers. We clearly state we are TopGear Karting, we don’t claim to be part of the BBC show or that it sponsors us. We are a karting centre in the North East that believe it or not offers karting, we don’t talk about or race fancy over priced cars.
So a few things have changed on our website…mainly the use of ‘The Stig’ he will still be used and pictured for children’s parties just under a new alias.
The letter to TopGear Karting must have been the cherry on top for Chris Evans as he resigned yesterday after just six shocking episodes. Oh dear.
Now it’s back to business as usual.
